POSH Act

Introduction

The Sexual Harassment of women at workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act 2013) is a legislation whose aim is to safeguard women from sexual abuse at workplace. This Act was enacted to provide a safe and secure working environment for women.

Important Provisions of the POSH Act:

  • Every employer should draft a POSH policy mentioning that the organisation treats the sexual harassment as a misconduct under the service rules.
  • Every employer employing 10 or more persons should form an Internal Complaint Committee to address complaints of sexual harassment.
  • The name, email id, and phone number of the Internal Complaint Committee should be displayed at the entrance of the organisation.
  • Employer must take steps to prevent sexual harassment and ensure that the victims are not discriminated against.
  • Employer should take steps to ensure that all the employees should be aware about the existence of policy in the organisation.
  • Employer should conduct awareness programme against sexual harassment for employees as well as the member of the POSH Committee.

Sexual Harassment includes

  • Physical contact
  • Abusive Sounds
  • Making sexually colored remarks
  • Using sexually abusive language or signs in the presence of woman employee
  • Showing pornography or the likes;
  • Stalking
  • Vulgar/indecent jokes, phone calls, text massages, e-mails,
  • Physical confinement or touches against the will and likely to intrude upon one's privacy; or
  • Demand or request for sexual favours.
